Case Account 01

An intestate estate with property and three adult children

The Situation

A man in his late seventies passed away in Kuala Lumpur without a will. He left a house in Petaling Jaya, a fixed deposit account, and three adult children — two in Malaysia, one abroad. There was no prior legal planning and the family had no idea where to start.

What We Did

We began with an estate and will guidance session to orient the family, then took on the full administration. This included applying for letters of administration, liaising with the land office and the bank, and coordinating with the sibling abroad via written correspondence. Each stage was explained before it commenced.

The Outcome

The estate was fully administered within seven months. The property was transferred to the three children as tenants in common in equal shares, consistent with the Distribution Act 1958. The family agreed at the close that having a clear, explained process had made an otherwise painful period more manageable.

Case Account 02

Representation in a contested probate matter

The Situation

A widow in her sixties had been excluded from her late husband's will in favour of his children from a previous marriage. She believed she had a legitimate claim but felt overwhelmed by the prospect of a legal dispute, particularly so shortly after his death.

We took on her representation with careful preparation of the relevant documentation and respectful correspondence with the opposing party. We explained to her at each stage what the proceedings meant and what the realistic possibilities were, without overstating the likelihood of any particular outcome.

The Outcome

The matter was resolved through negotiation rather than a full court hearing. The widow received an agreed distribution from the estate that recognised her contribution to the matrimonial home. The process took approximately nine months. She reported feeling that her position had been heard and considered fairly.
