"User", "you", "your" refers to any person accessing the Website or engaging our services.

"Services" refers to the legal services described on this Website, including estate and will guidance, estate administration help, and representation in inheritance matters.

"Engagement Letter" refers to the written agreement setting out the scope of legal services, fees, and terms of a specific instruction.

"Content" refers to all text, images, documents, and materials published on this Website.

By accessing this Website or submitting an enquiry, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are acting on behalf of another person, you confirm that you have authority to do so.

Use of this Website constitutes acceptance of these Terms. If you do not agree, please do not use this Website or engage our services through it.

Waris Amanah provides inheritance law services in Malaysia, including estate and will guidance (from RM 237), estate administration help (from RM 283), and representation in inheritance matters (from RM 329). Services are provided in Kuala Lumpur and, by arrangement, to clients throughout Malaysia.

The Website provides general information about our services. It does not constitute legal advice. A formal legal relationship is established only upon execution of a written Engagement Letter.

We reserve the right to decline any instruction without providing reasons, in accordance with our professional obligations under the Legal Profession Act 1976.

When using this Website, you agree to:

• Provide accurate and complete information in any enquiry or instruction
• Not use the Website for any unlawful purpose or in any way that violates applicable Malaysian law
• Not attempt to gain unauthorised access to any part of the Website or its systems

In the course of a legal instruction, you agree to cooperate with us fully, provide documents and information promptly when requested, and not knowingly provide false or misleading information.

Legal documents prepared by us in the course of a client matter remain our intellectual property until fees are settled in full, at which point copyright in those documents transfers to the client for the specific purpose of that matter.

Fees for our services are stated in Malaysian Ringgit (RM) and confirmed in writing in the Engagement Letter before any work commences. Indicated prices on this Website are starting figures and may vary depending on the complexity of a specific matter.

Payment is due in accordance with the schedule set out in the Engagement Letter. We accept payment by bank transfer to our client account. We do not accept cash payments. Invoices are issued at the stages agreed in the Engagement Letter.

Where a matter does not proceed to conclusion through no fault of Waris Amanah, fees for work completed to that point are due and payable. Refunds are not available for completed work.

Scope: The scope of each instruction is defined in the Engagement Letter. Work outside that scope requires a separate written agreement.

Timelines: Estimated timelines are provided as guidance only. Many factors affecting the duration of an estate matter — including court processing times, third-party responses, and the complexity of family circumstances — are outside our control.

Confidentiality: We maintain strict confidentiality over all client matter information, subject only to our professional obligations under the Bar Council's rules and applicable Malaysian law.

Changes to scope: If during a matter it becomes apparent that additional work beyond the agreed scope is required, we will advise you in writing and obtain your agreement before proceeding.

Termination by client: You may terminate an instruction at any time by written notice. Fees for work completed to the date of termination remain payable.

Termination by Waris Amanah: We may cease to act for you in circumstances permitted by our professional rules, including where there is a conflict of interest, where you have provided materially misleading information, or where fees remain outstanding beyond the agreed terms.

Nothing in these Terms excludes our liability for fraud, for professional negligence resulting in direct financial loss, or for any matter that cannot be excluded under Malaysian law.

We carry professional indemnity insurance as required by the Malaysian Bar.

These Terms and any dispute arising from them are governed by the laws of Malaysia. The courts of Malaysia have exclusive jurisdiction to resolve any dispute arising from these Terms or from a legal instruction by Waris Amanah.

If you have a complaint about our services, we encourage you to raise it with us directly in the first instance at [email protected]. We are committed to addressing complaints promptly and fairly. If a complaint cannot be resolved between us, you may refer it to the Malaysian Bar's Disciplinary Board.

Entire agreement: For website use, these Terms constitute the entire agreement between you and Waris Amanah. For legal services, these Terms together with the written Engagement Letter form the entire agreement.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force.

Waiver: Our failure to enforce any right under these Terms does not constitute a waiver of that right.

Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in the context of a firm restructure or merger.
